Real Estate & Mortgage Financing

I can assist you in structuring and negotiating a seller take-back mortgage or agreement for sale – alternatives to conventional buying and financing.
I can help you with questions about a property’s title, understanding the legal terminology in your real estate documents, or if you would like advice and assistance closing a transaction.
Wills
I prefer clear, concise wills that one’s family, executor, and beneficiaries can understand.
You will want to consider whom to name your Executor and Trustee — that is, the person who will administer your affairs and property and distribute your estate after payment of any debts. Your Executor should be someone you trust, preferably younger than you, who lives in BC, and is organized and capable of handling paperwork.

Powers of Attorney
A Power of Attorney is a document enabling another to take care of some or all of your legal or financial affairs on your behalf. Essentially, under a Power of Attorney you empower another to act as your agent.
A Power of Attorney can be drafted narrowly or broadly within certain limits of the law. You may want to grant someone Power of Attorney if you need an agent to buy or sell property on your behalf while you are away. Or you may want to ensure that the person you choose to act as your Attorney can use funds to care for you should you become incapacitated. This is known as an Enduring Power of Attorney. (Regular Powers of Attorney become invalid if the donor of the power becomes incapacitated, whereas an Enduring Power of Attorney endures until the donor’s death or upon the occurrence of some other specified event. )
A Representation Agreement ensures that your wishes for major and minor healthcare, lifestyle, and end-of-life decisions are in good hands by your naming a trusted Representative to act for you should you become incapable of caring for yourself or making healthcare decisions for yourself.
Advance Directives allow you to spell out your wishes in advance so that healthcare practitioners need not rely on a Representative to make the right decision when you cannot. Advance Directives are useful if you do not desire a Representative and/or have specific wishes that you are more comfortable spelling out in advance. Or, you may have a Representative for most matters but an Advance Directive to cover a specific circumstance that you may not be comfortable leaving to your Representative.

About Me
My focus is real estate and incapacity planning. I was called to the bar in 2009 and opened Madrona Law Office in 2012. I articled at a Vancouver firm prominent in labour, employment, and human rights law.
In addition to English, I speak Spanish, French, and Portuguese.
I am part of the Advisory Planning Commission for Gabriola’s Local Trust Committee, which I chaired for a year, and I sat on the board of the Gabriola Land & Trails Trust for 3 years.
You may recall my role as Ruby of Elsinore or seen me in a number of other theatrical productions with the Gabriola Players.
I support local artists & farmers.
